Conversion of Title

Under Section 35 of the Registration of Title Act 1964, ownership of property that was subject to equities on the 1 January 1967 is deemed to be a “possessory title”. Under the 1964 Act a note that the title is “possessory” is now entered on the register instead of the note that the title was subject to equities.  

There are three classes of title which relate to Freehold, Absolute, Possessory, and Qualified.  

Applications for conversion of title are provided for in Section 50 of the Registration of Title Act 1964 and Rules 32 to 39 of the Land Registration Rules 2012. 

Usually, conversion of title applications are used to convert Possessory titles to Absolute. However, provision is also made for conversion of Qualified titles.

The relevant forms for use in Conversion of Title are: 

  • LR Form 10 – Application for the conversion of possessory title, purchased under the Land Purchase Acts, registered for 30 years (Rule 32) 
  • LR Form 10 – Application for the conversion of possessory title, purchased under the Land Purchase Acts, registered for over 12 years, where the applicant claims under a transfer for valuable consideration registered not less than 12 years prior to the application (Rule 33) 
  • LR Form 11 – Application for the conversion of possessory title, purchased under the Land Purchase Acts, where the applicant does not rely on legal opinion in regard to the title prior to such purchase (Rule 35) 
  • LR Form 12 – Application for the conversion of possessory title, purchased under the Land Purchase Acts, where the applicant relies on legal opinion in regard to the title prior to such purchase (Rules 35 and 36) 
  • LR Form 13 – Application for the conversion of possessory title, purchased under the Land Purchase Acts and subsequently acquired on sale or by a Local Authority , on a certificate of solicitor where the compensation or purchase money does not exceed €1,000,000 (Rule 34) 
  • LR Form 14 – Application for the conversion of possessory title to which Section 50(2)(a) of the Registration of Title Act 1964 applies (Rule 37(1) and 38)  
  • LR Form 14 – Applications to convert qualified title (Rule 39) 
  • LR Form 15 – Application for the conversion of possessory title to which Section 50(2)(a) of the Registration of Title Act 1964 does NOT apply (Rule 37(3) and 38).
