Property Adjustment Orders

These Rules, which will come into effect on the 1st of November 2009, provide for cancellation of Property Adjustment Orders pursuant to sections 74 and 75 of the Civil Law (Miscellaneous Provisions) Act 2008 where the Authority is satisfied that the order has been complied with.

Rule 3 prescribes the proof of compliance on foot of which the Authority can be so satisfied:

  • a solicitor’s certificate in Form 13
  • an affidavit by the claimant in the family law proceedings in Form 14 or
  • the consent of all the parties to the proceedings in Form 15
