Rule 120 – Recognisances, bonds and judgments

 (1) An application for registration of a recognisance or other matter referred to in Section 117(2)(a) of the Act as a burden shall be made by lodging in the Registry the memorandum prescribed by Section 11 of the Judgments (Ireland) Act, 1844, together with evidence that the person whose estate or interest is sought to be affected is either the registered owner or, in the case of settled land, another person having an estate or interest in the property under the settlement against whom registration is applied for. The memorandum shall be signed by the applicant or his/her solicitor and shall have subscribed a certificate of the existence of the recognisance or other matter by the proper officer of the court in which it was obtained or by some other duly authorised person. 

(2) The entry in the register of a recognisance shall be in Form 66. The entry in the register of the other matters referred to in the said Section 117(2)(a) of the Act shall be in a like form, with such variation as the case may require and the Authority allows. 

(3) An application for the discharge of a recognisance or a State bond shall be made by lodging in the Registry a certificate of vacate. 

(4) An application for the discharge of a judgment shall be made by lodging in the Registry a certificate of the satisfaction of the judgment.
