The quickest way to see whether a right of way has been registered on the Land Register is to search for the property on www.landdirect.ie. Using the search tools available, identify the property on the map and any registered rights of way are typically shown shaded yellow on the map.
Additionally, you may obtain a copy of the relevant folio to inspect the details of the burden registered on part three of the folio over which you have a right of access. For example, if you have a registered right to use a laneway which is on your neighbour’s property, you should inspect a copy of your neighbour’s folio to see the details of the burden registered on part three.
The folios and maps of the Register constitute a public record and any person may apply to obtain a copy folio/title plan, on payment of the appropriate fee. You can apply for a plain copy folio for €5 on landdirect.ie.
If the property on which you believe you have a right of way is unregistered lands, then a search of the Registry of Deeds may be appropriate to understand whether the grant of right of way has been noted.
